1.1 CLIENT bears all responsibility for ensuring effective cancellation of CLIENT account. This responsibility includes providing effective and authenticated notification to PageDNA of CLIENT's desire to cancel an account. This responsibility shall not be waived or modified by PageDNA or CLIENT in any way at any time subsequent to the submission by CLIENT of an application for PageDNA account. PageDNA will act immediately to implement CLIENT's cancellation notice, providing the terms of this cancellation policy have been followed. 1.2 CLIENT must provide effective notice of cancellation in writing delivered via Official Registered Post at least 30 days prior to the expiration of the current paid hosting, reseller or other internet services period in order to avoid charges for future hosting, reselling or other internet services periods. Cancellation will be effective immediately upon PageDNA's acceptance of receipt of notice of cancellation and return notification to CLIENT in writing via email or Official Registered Post. No refunds are provided for unused services, monies paid, setup fees, deposits or partial payments paid. No cancellation fee's or outstanding term of contract balances beyond 30 days will be charged by PageDNA. 1.3 Accounts cancellation may be initiated firstly by completing the online cancellation request form then also sending the request of Cancellation in writing via Official Registered Post. Telephone, facsimile, e-mail or other forms of cancellation requests are not accepted. To protect CLIENT against bogus or malicious account cancellation, cancellation requests must be authenticated by: 1.4 Using the Official Online Cancellation Form, providing the original account details including login and password provided with initial account setup; This will be reviewed against the original application lodged to ensure validity and then cross referenced against the written cancellation request sent to PageDNA via Official Registered Post. 1.5 All cancellation requests are processed and confirmed via email by PageDNA within 24 hours of receipt of the cancellation request in writing via Official Registered Post. Requests for cancellations to take effect on some future or prior date and time will not be accepted -- submission of the cancellation request form and receipt of Cancellation request via Official Registered Post shall be assumed to be authorization for immediate account cancellation. At the time of cancellation, all services related to the account will be terminated, and all files remaining on the account will be permanently deleted from PageDNA's servers. 1.6 If CLIENT does not receive confirmation of cancellation in writing via Official Registered Post, cancellation can not be assumed to have been effected. It is CLIENT's responsibility to ensure that a cancellation confirmation is forthcoming from PageDNA. The purpose of requiring confirmation of cancellation is to protect both CLIENT and PageDNA from inaccurate claims of cancellation and notification. 1.7 If CLIENT has a balance due or owing at the time of cancellation, this balance must be paid in full. Cancellation does not absolve CLIENT of any outstanding financial obligations. 1.8 CLIENT REVOCATION OF PAYMENT: The issuance of credit card chargebacks, check stop-payments, or any other attempt by CLIENT to revoke a payment or payments with the intention of circumventing any section of this agreement shall constitute criminal fraud and will impose on CLIENT criminal penalties as well as civil penalties equal to the greater of 1) three-times actual damages, or 2) $2,500. In addition to the aforementioned monetary damages, CLIENT agrees to pay PageDNA's legal and collection fees, court costs, and all other direct and incidental costs arising out of PageDNA's efforts to enforce this clause. 1.9 DEFINITIONS AND INTERPRETATIONS Unless the contrary intention appears, in this agreement, the following words have these meanings: "PageDNA Hosting Website" means any website(s) at http://www.nationsprint.com/clients/(client_name) or same vhosted under client's URL. "Plan Terms" means the terms that are applicable to the Plans and are annexed to these terms. "We, us, our or PageDNA" means and includes a reference to PageDNA's Internet Services. "You, Your Customer or Client" means and includes a reference to You, your assigns, agents, contractors, officers, employees and anyone else (other than PageDNA). Unless the contrary intention appears, a reference to: (a) this agreement is a reference to the documents referred to in this agreement (including this agreement) (b) a document (including this agreement) includes any variation or replacement of it; (c) a clause is a reference to a clause in this agreement; (d) law means common law, principles of equity, and laws made by parliament (and laws made by parliament include State, Territory and Commonwealth laws and regulations and other instruments under them, and consolidations, amendments, re-enactments or replacements of any of them); (e) an amount of money is a reference to the lawful currency of the United States; (f) a day is a calendar day and is to be interpreted as the period of time commencing at midnight and ending 24 hours later; and (g) the words "include", "including", "for example", or "such as" are not to be interpreted as words of limitation, and when such words introduce an example, they do not limit the meaning of the words to which the example relates, or to examples of a similar kind.
